Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you") and OrientalMuse ("Company", "we", "us", "our"), governing your access to and use of the website located at orientalmuse.com and all associated services (collectively, the "Service").

By creating an account, purchasing a subscription, or otherwise accessing the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference.

You must meet all of the following criteria to use the Service:

• You are at least 18 years of age, or the age of majority in your jurisdiction, whichever is greater.
• You have the legal capacity to enter into a binding agreement.
• You are not prohibited from using the Service under the laws of your jurisdiction.
• You have not been previously banned from the Service by us.

By using the Service, you represent and warrant that you meet all eligibility requirements.

To access certain features, you must register for an account. When registering, you agree to:

• Provide accurate, current, and complete information.
• Maintain and promptly update your account information.
• Keep your password confidential and not share it with any third party.
• Notify us immediately at security@orientalmuse.com of any unauthorized use of your account.
• Accept responsibility for all activities that occur under your account.

We reserve the right to suspend or terminate your account if we believe you have violated these Terms or if your account has been compromised.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial purposes.

Free users may:

• Browse watermarked preview images at reduced resolution (up to 800px).
• Save images to your personal favorites list within the Service.
• Share links to image pages on OrientalMuse.

Premium members additionally may:

• Download high-resolution, watermark-free images for personal use.
• Use downloaded images as personal wallpapers, screensavers, or for other non-commercial private purposes.
• Access exclusive premium collections.

All users may not:

• Redistribute, resell, sublicense, or commercially exploit any images from the Service.
• Use images in any commercial product, advertisement, or for-profit purpose without a separate commercial license agreement.
• Remove, alter, or obscure any watermarks or copyright notices.
• Claim ownership or authorship of any images obtained through the Service.

You agree not to engage in any of the following:

• Scraping, crawling, or otherwise systematically collecting images or data from the Service without our written permission.
• Using automated scripts, bots, or tools to access, download, or interact with the Service.
• Attempting to circumvent any access control, paywall, or digital rights management system.
• Sharing your account credentials or Premium access with others.
• Uploading, posting, or transmitting any content that is unlawful, defamatory, or infringes any third-party rights.
• Attempting to interfere with, disrupt, or disable the Service or its infrastructure.
• Impersonating any person or entity, or falsely representing your affiliation with any person or entity.
• Violating any applicable local, national, or international law or regulation.

Violation of this section may result in immediate account termination and, where applicable, legal action.

All images, text, graphics, logos, and other content published on OrientalMuse ("Content") are owned by or licensed to us and are protected by copyright, trademark, and other intellectual property laws.

The OrientalMuse name, logo, and associated marks are our trademarks. You may not use them without our prior written consent.

If you believe any Content on the Service infringes your copyright, please refer to our DMCA Policy for instructions on submitting a takedown notice.

We respect the rights of the models and photographers who contribute to the Service. All content is published with appropriate consents and model releases. Any unauthorized use of likeness rights or portrait rights is strictly prohibited.

OrientalMuse offers optional paid subscription plans ("Premium", "Basic") processed by Paddle, our Merchant of Record. By subscribing, you agree to Paddle's terms and conditions in addition to these Terms.

• Billing — subscriptions are billed on a recurring monthly or annual basis from the date of purchase. You authorize us (via Paddle) to charge your payment method on each renewal date.
• Price changes — we may change subscription prices with at least 30 days' notice. Continued use after the effective date constitutes acceptance of the new price.
• Cancellation — you may cancel at any time from your account dashboard. Cancellation takes effect at the end of the current billing period; you retain Premium access until that date. No partial refunds are issued for unused periods, except as required by law.
• Refunds — we offer a 7-day money-back guarantee for new subscribers. To request a refund, contact billing@orientalmuse.com within 7 days of your first payment.
• Taxes — Paddle, as Merchant of Record, is responsible for calculating and remitting applicable taxes (VAT, GST, sales tax) based on your location.

By you: You may close your account at any time by visiting your account settings. Active subscriptions must be cancelled separately before account deletion to avoid further charges.

By us: We reserve the right to suspend or terminate your account and access to the Service, with or without notice, for any reason including but not limited to: violation of these Terms, fraudulent activity, extended inactivity, or as required by law.

Upon termination, your license to use the Service immediately ceases. Provisions of these Terms that by their nature should survive termination (including IP rights, disclaimers, liability limitations, and dispute resolution) will remain in effect.

We do not warrant that: (a) the Service will be uninterrupted, error-free, or secure; (b) the results obtained from using the Service will be accurate or reliable; or (c) any Content will be free of viruses or other harmful components.

Some jurisdictions do not allow the exclusion of certain warranties. In such jurisdictions, the above exclusions apply to the fullest extent permitted by applicable law.

To the maximum extent permitted by applicable law, OrientalMuse and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with your use of the Service.

In no event shall our total liability to you for all claims exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) USD $50.

You agree to indemnify, defend, and hold harmless OrientalMuse and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your access to or use of the Service; (b) your violation of these Terms; or (c) your violation of any third-party rights, including intellectual property or privacy rights.

These Terms are governed by and construed in accordance with applicable law. Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration under widely recognized arbitration rules.

Class action waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

Notwithstanding the above, either party may seek emergency injunctive or other equitable relief in a court of competent jurisdiction to prevent irreparable harm.

We may modify these Terms at any time. When we make material changes, we will update the "Last updated" date and notify registered users by email at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Service and may close your account.
