DMCA Policy
If you believe content on OrientalMuse infringes your copyright, email a takedown notice to dmca@orientalmuse.com. We will process valid notices promptly. If your content was removed in error, you may file a counter-notice.
1. Overview
OrientalMuse respects the intellectual property rights of others and expects users and content contributors to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), 17 U.S.C. § 512, we have implemented procedures for receiving notices of claimed copyright infringement and for processing counter-notices by users whose content is removed.
We respond expeditiously to valid DMCA takedown notices. Upon receiving a complete and compliant notice, we will:
- Remove or disable access to the allegedly infringing content.
- Notify the uploader (where applicable) that the content has been removed.
- Provide information about filing a counter-notice if the removal was made in error.
This policy covers content hosted on orientalmuse.com and any associated subdomains.
2. Filing a Takedown Notice
To submit a DMCA takedown notice, you must be the copyright owner or authorized to act on the owner's behalf. Your notice must include all of the following elements as required by 17 U.S.C. § 512(c)(3):
- Identification of the copyrighted work — a description of the copyrighted work(s) you claim have been infringed. If multiple works are covered, provide a representative list.
- Identification of the infringing material — the specific URL(s) or sufficient information to locate the allegedly infringing content on our service. Vague descriptions will not be actioned.
- Your contact information — your full legal name, mailing address, telephone number, and email address.
- Statement of good faith — a statement that you have a good faith belief that the disputed use of the material is not authorized by the copyright owner, its agent, or the law.
- Statement of accuracy — a statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf.
- Electronic or physical signature — your signature (electronic or physical) as the copyright owner or authorized agent.
Warning: Submitting a DMCA notice with materially false information may expose you to liability for damages, including costs and attorneys' fees, under 17 U.S.C. § 512(f). Only submit a notice if you have a good faith belief that your copyright has been infringed.

3. Filing a Counter-Notice
If you believe your content was removed (or access to it was disabled) as a result of a mistake or misidentification, you may submit a counter-notice under 17 U.S.C. § 512(g)(3). A valid counter-notice must include:
- Identification of the removed material — the specific URL(s) of the content that was removed and its location before removal.
- Statement under penalty of perjury — a statement that you have a good faith belief that the content was removed as a result of mistake or misidentification.
- Consent to jurisdiction — a statement that you consent to the jurisdiction of the federal district court for your judicial district (if in the US) or any judicial district in which OrientalMuse may be found.
- Your contact information — your full legal name, mailing address, telephone number, and email address.
- Your signature — your electronic or physical signature.

Warning: Filing a false counter-notice may expose you to liability. Only submit a counter-notice if you genuinely believe the content was removed in error.
4. Our Process
Upon receiving a complete and valid DMCA takedown notice, we follow this process:
- Acknowledgment — we acknowledge receipt of your notice within 2 business days.
- Review — we review the notice for completeness. Incomplete notices will be returned with a description of what is missing.
- Action — if the notice is complete and valid, we will remove or disable access to the allegedly infringing content, generally within 5 business days.
- Notification — we will notify the alleged infringer that their content was removed and provide them a copy of the notice (with your personal contact information redacted where legally permissible).
- Counter-notice period — if a valid counter-notice is received, we will forward it to the original complainant. If the complainant does not notify us within 10 business days that they have filed a court action, we may restore the removed content at our discretion.
5. Repeat Infringer Policy
In accordance with 17 U.S.C. § 512(i), OrientalMuse maintains a policy of terminating accounts of users who are repeat copyright infringers.
A user who receives three or more valid DMCA takedown notices within a 12-month period will have their account permanently terminated, regardless of any counter-notices filed. We reserve the right to terminate accounts of users who we believe, in our sole discretion, are repeat infringers even before the three-notice threshold is reached.
Terminated users forfeit any remaining subscription period without refund.
6. Good Faith & Abuse
The DMCA is intended to protect copyright owners from infringement, not to suppress lawful content or competitive activity. We take abuse of this process seriously.
We may decline to process notices that we believe are submitted in bad faith, including notices that:
- Target content that clearly does not infringe on any copyright.
- Target content that is covered by fair use, fair dealing, or similar doctrines.
- Are submitted by parties who do not hold the claimed rights.
- Are submitted as competitive suppression rather than genuine copyright enforcement.
Parties who submit abusive or fraudulent notices may be reported to relevant authorities and may face legal liability under 17 U.S.C. § 512(f).
